30 Arrested and Indicted in Major #HeroinBust #Pittsburgh

In a major bust, authorities have dismantled an alleged gang which is said to have sold millions of dollars worth of heroin in Pennsylvania.

Various members of the alleged gang, which authorities say called itself “Bricks-R-Us” (B.R.U.), were arrested this week in Monroeville. According to U.S. Attorney David Hickton, the group sold vast quantities of the drug from Newark, N.J. to Pittsburgh, and also in Armstrong and Cambria counties.

Agents arrested 30 people in an early morning and afternoon sweep on Thursday, and are continuing to seek 14 additional individuals. The raids involved over 200 police and law enforcement agents representing dozens of local, state, and federal agencies. Several of the defendants are said to be minors under the age of 18.

The recent explosion of deaths of people who have used heroin laced with fentanyl, a powerful and extremely dangerous narcotic, has resulted in increasing crackdowns by Pennsylvania authorities.

Lawrenceville Marijuana Grow-house Burglary Bust Leads to Three Arrests. #Pittsburgh

Pittsburgh police allegedly discovered a large marijuana grow in the city this week, in a bust which resulted in three arrests.

Pittsburgh police allege that a marijuana grow operation, containing over 300 plants, was discovered in Lawrenceville. Police say that the grow was located in a commercial building, at the intersection of Davison Street and Urbana Way, on the second floor. Apparently police were led to the grow as a result of an early morning 911 call on Thursday, which reported a burglary in process at the location.

Upon arrival police allegedly encountered two suspects, ages 30 and 31, burglarizing bags of marijuana from the building, and a third suspect, age 34, waiting in the area as the getaway driver.

The men face various charges, including possession with intent to distribute, burglary, and possessing instruments of crime.

Police say that an investigation is ongoing to determine who was growing the marijuana.

Franklin Township police, working with Pennsylvania State Police, arrested four suspects Wednesday who are alleged to have been running a meth lab out of an area home. The neighbor says that he found the house suspicious due to high levels of activity at all times of the day and night.

The 50 year-old mother, along with her 17 year old son and two teenage daughters, were at all their home near the intersection of Huxley and Sutherland Streets when Zone Six narcotics detectives arrived on the scene with a search warrant. Two Women Charged with Hoagie-Fundraiser Scam in Carrick

Two Pittsburgh area women were recently arrested on charges that they fraudulently offered local residents the opportunity to purchase hoagie sandwiches, which were to be delivered at a later time. It turns out that the offer was a complete scam.

Police allege that a 27 year-old Pittsburgh woman went door to door in Carrick, pre-selling hoagie sandwiches to residents for $6.00 a piece. It turns out that the woman, who told the residents that she was selling the sandwiches as part of a fundraiser, was allegedly perpetrating a scam. Police also allege that a 31 year-old area woman was also involved in the scheme. In all, approximately just 100 sales were made.

Police are attempting to make a list of all for women’s victims. Possible charges could include theft by deception, receiving stolen property and criminal conspiracy.

Castle Doctrine Defense: Pittsburgh Criminal Lawyer Obtains Acquittal on Washington County Homicide

The Pittsburgh Criminal Law firm of FrankWalkerLaw obtained an acquittal on Homicide Charges in a widely publicized Murder Trial involving Self-Defense.

The central issue was whether a decorated Afghanistan and Iraqi veteran, Brandon Thomas, was found NOT GUILTY of First Degree Murder, Second Degree Murder, Third Degree Murder or Voluntary Homicide when he shot and killed Vaughn Simonelli.  To reach their verdict, the Washington County Jury had to determine whether Mr. Thomas was justified in his actions or whether his actions were protected under the Castle Doctrine Law of Pennsylvania.

Generally, to establish the defense of self-defense, or defense of others, it must be shown that a) the slayer, or the other he seeks to protect, was free from fault in provoking or continuing the difficulty which resulted in the slaying; b) that the slayer must have reasonably believed that he [or the other he seeks to protect] was in imminent danger of death or great bodily harm, and that there was a necessity to use such force in order to save himself [or the other] therefrom; and c) the slayer [or the other he seeks to protect] did not violate any duty to retreat or to avoid the danger.

If there is any evidence from whatever source that will support these three elements then the decision as to whether the claim is a valid one is left to the jury and the jury must be charged properly thereon by the trial court.

However, the case of Commonwealth v. Brandon Thomas is unique because it was the first case where the Castle Doctrine was raised as a defense in addition to the general rule of Self-Defense or Justification.

The Castle Doctrine of Pennsylvania provides that an actor is presumed to have a reasonable belief that deadly force is immediately necessary to protect himself against death, serious bodily injury, kidnapping or sexual intercourse compelled by force or threat if both of the following conditions exist: The person against whom the force is used is in the process of unlawfully and forcefully entering, or has unlawfully and forcefully entered and is present within, a dwelling, residence or occupied vehicle; or the person against whom the force is used is or is attempting to unlawfully and forcefully remove another against that other’s will from the dwelling, residence or occupied vehicle.

In Commonwealth v. Thomas, the Defense established through witness and scientific evidence that Mr. Thomas was in his car during the time of the shooting and that the assailant, Vaughn Simonelli, was unlawfully attacking Mr. Thomas through the window of of his vehicle. Applying the law of self defense and Castle Doctrine Defense, the jury was free to presume that the Defendant’s force used against Vaughn Simonelli was lawful and accordingly found Mr. Thomas justified and acquitted him of Murder and Manslaughter charges.

Pittsburgh Criminal Lawyer Frank Walker was satisfied with the verdict and simply stated, “The jury heard the facts and found that Vaughn Simonelli attacked Mr. Thomas, Mr. Thomas retreated to his car and was attacked again by Vaughn Simonelli when he attempted to enter and attack Mr. Thomas through his car window. Mr. Thomas used whatever force was necessary to defend himself against the attack and the jury found the same.”

Leniency Sought For Former City Of Pittsburgh Employee Charged With Bid Rigging

Lawyers for a former City of Pittsburgh employee who is accused of rigging bids for city contracts have stated that they believe the accused will receive probation. The bid-rigging that was conducted by the employee was found as part of an investigation by federal authorities into the city’s operations. The defendant’s lawyers claim that the city of Pittsburgh was not “materially” harmed by the bid-rigging efforts because in the end, the city selected the lowest bidder which it always does in these situations. And the work for which it was contracted was performed according to that contract.

The defendant pleaded guilty in December of 2012 to helping to defraud the United States government out of grant money by making the claim that one of the contracting companies was a female-owned business, when it in fact was not. The claim led to a contract for the business, which saw the city pay out $327,000 for the installation of laptops into Pittsburgh police cars. The defendant herself was paid $6,000 for her efforts in helping to win the contract, by rigging the bid with the false claim about the owners of the company.

The owner of the company has pled guilty to charges of conspiracy, bribery, and mail fraud, and was sentenced last month to three years of probation. Other investigations stemming from the initial federal probe into the rigged bidding led to the discovery of indiscretions within police bureau operations, as well as the resignation of the former Pittsburgh Chief of Police.

The defendant also was charged with tapping into secret police accounts for personal use, and failure to file income tax returns, charges to which she has pled guilty.

Pittsburgh Drug Ring Sold Meth as Ecstasy

Pittsburgh authorities allege that drug dealers are going to new and even more dangerous lengths in order to peddle their wares to unsuspecting users. A drug ring in the Pittsburgh area was allegedly selling extremely dangerous methamphetamines to local drug users by claiming it was the club/rave drug known as Ecstasy. Federal officials said last Friday that suburban locations such as the Mall at Robinson, selected for their inconspicuous nature, were used by members of the ring as meet-up locations for their buyers.

A 29-year-old North Fayette man was alleged to be the leader of the drug ring, and is accused of trying to generate an entirely new market in the drug trade by selling meth and claiming it was Ecstasy. According to Michael Christmas, FBI supervisory special agent, the drug ring was being investigated as the result of a 14-person indictment.

Ecstasy is commonly sold to college-age individuals for club and rave parties, and has an entirely different effect on the body and mind than methamphetamines do. The people who took the drug under the auspices that it was Ecstasy told police that they wondered why they remained wide awake for days, a characteristic that is one of the effects of meth. The drug that was being sold was tested as being 90% meth with the remaining 10% being Ecstasy. According to investigators, the indictment began in early 2013, and led to revelations that a group of people headquartered near the Pittsburgh airport was having meth shipped in from Cleveland, as well as heroin and marijuana shipped in from New York City.

The ring leader is likely to be charged with conspiracy to possess and distribute methamphetamines and heroin, as well as possession of a firearm in furtherance of drug trafficking.
