Sex, Alcohol, and Consent on College Campuses – Frank Walker Law

College is a time where many adults begin living on their own and take their first steps into personal responsibility. For many young adults, it is also a time for experimentation with drugs and alcohol, and their first time living alone.  A college campus is a great place for young people to meet others in their age group, socialize, and pursue relationships.  However, the combination of youth, drugs and alcohol, and inexperience can lead to difficult situations in the eyes of the law.

Accusations of rape, sexual assault, and other sex and alcohol related crimes are common in a college campus setting.  In these cases usually there is no dispute as to whether sex occurred, instead the issue centers around whether that sex was consensual. Unfortunately in most cases of sex related crimes there is limited evidence outside the testimony of the two individuals involved. Add in alcohol or drugs, and even the two people’s memories of who were there that night may not reflect the reality of exactly what happened.

When these events are reported to the college, what happens from there can spiral out of control. College Administration, in attempts to protect their reputation as safe for students and unwilling to put themselves at risk by making hard decisions, often suspend or expel those accused of sexual misconduct without opportunity for a hearing or meaningful investigation into what happened.  This can end a promising career and future for a young college attendee before it even gets started.

Even if a hearing is convened, students may potentially be denied the opportunity to be represented by counsel or to present a meaningful opportunity to challenge the accusations. These situations have been gaining prominence in the news as students and attorneys have been pushing back against the university’s summary dismissals without due process.

If you are a college student or other individual facing allegations of sexual misconduct, or have a son or daughter that is facing allegations through their university or criminal charges from the police, its important to lay down a strong defense early. Getting an attorney early on can prevent potentially irreparable damage from being done to someones reputation and future.  Attorney Frank Walker can help.  With years of experience in the criminal justice system and helping college aged individuals in their time of need, Attorney Walker can help you fight the charges and demand due process for the accused. Criminal Defense and Injury Attorney Stands Tall in #Morgantown, West Virginia. #WVU

Frank Walker Law Morgantown Lawyer WVU

If visitors and residents in Morgantown were not familiar with Attorney Frank Walker before today, the unfamiliarity will soon fade.

Morgantown Criminal Defense and Injury Attorney, Frank Walker of Frank Walker Law, has recently brokered an agreement to advertise on the large billboard in Morgantown, West Virginia right off the Star City exit.

According to Walker, the deal was a no brainer, “I drive past that billboard every time I come to my Morgantown office for Court. The board had been sitting empty for so long, it just made sense to place my ad in front of the thousands of other people passing the exact same billboard. The location is highly visible and one of the first and last advertisements people see when they enter or leave Morgantown for a business or pleasure.”

The Billboard advertisement is also visible to visiting teams and universities that fly into Pittsburgh Airport and drive into Morgantown to battle the WVU Mountaineers.

An alumnus of WVU Law, Walker has received tons of texts and emails from old professors and law school friends once the billboard was installed. Attorney Walker’s response to all the messages is simple, “It’s great to hear from old friends and seeing the billboard get captured and shared across social media, but just don’t text and drive!

Covert Drug Task Force Securing Indictments in West Virginia

At least fifteen federal drug indictments have been secured since the beginning of the year thanks to an unassuming but very effective task force in rural West Virginia. U.S. Attorney William Ihlenfeld introduced the task force in late January after it had already been working for several weeks to shut down known drug activity in Pocahontas, Randolph, and Tucker counties. Ihlenfeld stated that more arrests are expected over the next several days and weeks, and that there are a number of individuals who have already been named in drug indictments from last week that are as yet sealed.

According to Ihlenfeld, a “memorandum of understanding” was executed in late 2013 regarding the task force, but the board decided to wait until the task force had begun making indictments before it informed the public about its existence and activities. The reason for the delay is that several individuals and groups were already under investigation, and task force officials didn’t want to jeopardize those cases by going public too early.

One of the most important cases involved a 67-count indictment in which three individuals were charged with conspiracy to manufacture methamphetamine, and details how those individuals allegedly shopped for the ingredients to concoct their drugs. Six more individuals have also been identified in separate cases and charged with distribution of hydrocodone, cocaine, crack, and oxycodone, among other drugs. Ihlenfeld has declared that the task force is just getting started in its efforts to rid counties in rural West Virginia of dangerous and illegal street drugs.

The task force includes members of several law enforcement agencies including county sheriffs and prosecutors in the three aforementioned counties, the West Virginia State Police, Homeland Security Investigations, and the Drug Enforcement Administration (DEA). Members of the U.S. Postal Inspection Service, Homeland Security Investigations, and the Bureau of Alcohol, Tobacco, Firearms, and Explosives are also assisting in the task force efforts on a case-by-case basis.
